Rene Whatcome independent contractor who writes research report for several investment publications, Whatcome refuses to sign contracts with exclusivity clauses. Whatcome sometimes revises work he submits to one publication and sends slightly altered versions of the report to additional publications. Does whatcome violate any standards?

A) No
B) Yes with respect to loyalty
C) Yes with respect to disclosure of conflicts
D) Yes with respect to additional compensation

With regards to being a contractor i know it depends on the contract that he/she signed with employer, is the answer A ? but if in the contract it says it has exclusivity clauses then would the answer be B ?

Larry Bird CFA is a senior portofolio manager at KFC investments, He serves a board memeber for non profit organisations. These commitments require 8 workdays a month Because he does not receive any compensation is he required to tell anyone at work about his charity activities

A) no
B) Yes with respet to conflicts of interest
C) yes with respect to additional compensation
D) yes with respect to responsibiliites of supervisors

the answer was B) BUT if the commitments were only 1 or 2 days a months then would the answer be A ??

Cheers good luck ,

1. Leaning towards A
2. B, yes if his other commitments do not conflict with his work, he should be ok.

A for number 1.

I think it's B for number 2 but in one of the Schweser mocks, they defined this type of question as A...

It's one of the ethics topics that I usually get wrong...

A for 1
since

1) Whatcome independent contractor
2) Whatcome not sign contracts with exclusivity clauses

B for 2

even though Larry works for non profit organization , conflict may occurs with client interest.

#2 is def B

and A for 1

Is A the answer? In the academic publications I published in, these were all implied contracts. I HATED THIS QUESTION.
