I went through sort of a rough patch in my younger years where I got arrested and charged with several misdemeanors (non had anything to do with anything that might jeapordize my professional or ethical credibility). The charges were eventually reduced and sealed. As far as I know, these arrests and charges can still be seen on a background check even though I have no actual criminal record or convitions. Most major firms do extensive background checks and ask you to disclose this stuff on applications. These blackmarks do not reflect the person that I am today. Has anyone experienced a similar situation and what do you do in the case of disclosing these during the interview process and on applications?

I don’t share your experience, but I would try to find out for sure if they show up or not. I don’t know how much background checks cost, but might be worth it to have a background check done yourself to see what turns up. I’m pretty sure there are only a handful of companies that most employers use.

Yeah, my wife is an attorney and she ran a criminal check and nothing shows upt but I don’t know what else employers might use. Like I said the charges were pretty petty and explainable, but i would like to avoid having to explain anything. Also I don’t know how it would appear to a hiring manager if they saw this stuff appear.

Don’t worry about it. Anything before you’re 18 is sealed and can’t be found. Well, not by those guys anyway. I wouldn’t go to 4chan and challenge them to find it. For your purposes you’re fine.

Haha, well unfortunatley it hapened when i was in my early 20s. Trespassing at a hotel on spring break in college and another time I got a DUI. The trespassing was adjudicated and sealed and the DUI was changed to a non moving violation but I think still shows up on my driving record but not any criminal charge.

^ that may be difficult. How old are you now?
Would be interested to know what you did too get arrested.

31 years old. Currently work in finance for an RIA, no background check was done. The trespassing was flagged when I worked for a big brokerage and I had to explain it but that was before it was sealed. I’m not sure if either would show up now and I’m afraid to every apply for new jobs now.

Those charges really aren’t a big deal. One DUI is a none issue. I have one and HR didn’t care. Don’t get another though…that’s a different issue.
Go into sales. Those priors should actually help you.

Hmm. Well, I think the RIA channel is the way of the future and growing, so maybe you won’t have to apply to new jobs, especially at the wirehouses… why are you thinking of leaving your current firm?
trespassing, I don’t think they’d care.
DUI? happened only once, and they changed the status of it. Not the worst thing ever..
I thought it had something to do with manslaughter.

Haha, no. Alcohol is a terrible thing. =)
The DUI was after a world series game. Totally ridiculous. I would have thought that the cops would let me go. It was dropped to noise polution. The trespassing was after we got kicked out of a hotel on spring break.
I looked into the sealed trespassing charge and it looks like the only entities that can see it are Bar associations, federal agencies, and the teacher’s associations, so I might not even have to disclose it since it is hidden from public record. Anyone know about this?
Sweep the leg, did you disclose the DUI on your application or wait for them to find out later and was yours dropped?

It’s probably not that bad. They would be more stringent if you had some permanent mark on your U4 that is work related.

Those charges aren’t as bad as using the CFA as a noun. I hear you get blackballed from the industry for that.
