Urgent Help required.

Dear Firends,
I wrote my level 3 this time and I have landed into trouble. Just two days back a received a letter from the CFA Institute stating/alleging that I overwrote for 20 seconds after the time was called out. It also states that I handed over the paper to the proctor without any protest.
Now I/m very worried and tensed because I was not writting anything In fact I had completed the morning paper 5 mins before. All I can vagulely remember is that I was perhaps having my pen in hand.But definitely was not writing. I have got around a week’s time to reply.
Request you to guys to please recommend a way out of this soup.
 
Where did you take your exam in India?I am asking this question because in my center the papers were almost snatched away from us after the time was called off..so there was no opportunity to write for 20 seconds..
 
I will try to respond you with more detailed information, but my first recommendation: Thoroughly read the CFA Institute guidelines regarding the situation (exam guidelines). That way, when you defend your case, they will know that you are aware of your rights.

First of all, do search on internet and see how other candidates responded to similar allegations and how the results were. That being said, always keep your hopes up, do not be discouraged at all.

CAUTION: Be careful what you write or say as it can be used against you as evidence. If you mention that you were still holding your pen even after the proctors told everybody to stop, this alone might decide the case against you. Therefore, carefully remember what happened and be careful what you write/say.
Do not lie as there might be testimony of other proctors. Therefore, force yourself to remember all the details.
You should do the following steps:
1. Familiarize yourself with the procedures that you are going to face (http://www.cfainstitute.org/ethics/conduct/sanctions/Pages/misconduct.aspx)
2. Do research on internet in order to find out what happens to other candidates. You will find results on many sites, including this site. Whatever you read might depress you, but at least it will give you information about the fates of others.
3. Be articulate when your respond to the CFA Institute. Anything you write might be used against you. “Maybe I was holding a pen” will definitely kill your case. So, try to remember.
I wish you good luck! It is very unfortunate for any candidate to face this scenario. As a L3 retaker, I know it takes a lot from your life.
 
You can try as hard as you like but unfortunately you have bought great shame to both you and your family. Most likely scenario is 24-month holiday from the CFA program. Best you use this time to do some charity work and try to redeem yourself in the eyes of you peers before attempting Lvl 3 again.
 
You seem to have used your real name on AF. Remember this forum is monitored by CFAI and whatever you may say here may (or may not) be noticed by CFAI too. For PCP investigation that may not be helpful!
 
20 seconds is a long time. the “exam over pencils down now” announcement is maybe 10 seconds.

Dont rush to judgement…unless you were the proctor that filed the complaint, perhaps.

Some of you guys are offly mean to this person. I’m not excusing bad behavior but you don’t need to kick somebody when he or she is down.

It doesn’t matter, if OP got a PCP letter, then he’s already in trouble. It’s not like he came to AF bragging how he did in fact cheat, so what is said here doesn’t help/hurt him.

May be you are right but if AF is being indeed monitored (as many senior members do say) then his defence may get weakened if he wants to modify/ adjust/not reveal anything he claims here at first instance. Then it would certainly harm his case. As long it is done anonymously it may be ok but with real name it is a disclosure.
 
Sadly, I’m sure we’ve all seen many PCP threads in the past and I personally don’t remember any happy endings.
All the same it’s not nice to laugh at someone for their misfortune, unless they video it and send it to the local TV station.
